20. Governing Law and Jurisdiction
This Policy shall be governed by and construed in accordance with the laws of India. Subject to any non-excludable rights you may have under the laws of your place of residence, any dispute arising out of or in connection with this Policy shall be subject to the exclusive jurisdiction of the courts at Hyderabad, Telangana. Nothing in this Section limits your rights under the GDPR or the UK GDPR, including your right to complain to a supervisory authority and to bring proceedings in your country of residence.
21. EU, EEA and UK Residents (GDPR)
This Section applies where the General Data Protection Regulation (EU) 2016/679 or the UK GDPR applies to our Processing of your Personal Data. It adds to the rest of this Policy and, where they differ, this Section prevails for you.
21.1 Controller
The controller of your Personal Data is Tau Square Academy, a sole proprietorship of Niranjana Jayaraman, 37-116/5, Road Number 3, Neredmet, Secunderabad, Telangana 500056, India. Contact: privacy@tausquareacademy.com.
21.2 Lawful bases
- →Contract (Article 6(1)(b)): to create and run your account, deliver the program you buy, record your progress, provide mentoring and Doubt Tokens, take payment and respond to your requests before you enrol.
- →Legal obligation (Article 6(1)(c)): to issue and keep tax invoices, credit notes and accounting records required by Indian tax law.
- →Legitimate interests (Article 6(1)(f)): to secure accounts and enforce our device, session and account-sharing rules using account security data and lesson engagement data; to prevent fraud and abuse; to keep records of your acceptance of our Terms; to understand where learners struggle so that we can improve our programs; and to establish, exercise or defend legal claims. Our interests are protecting our students’ accounts and our course materials, which we can only offer as individual licences. We limit this Processing to what those purposes need and keep the data only for the periods in Section 10.
- →Consent (Article 6(1)(a)): for updates about our programs by WhatsApp or email that you ask to receive. You may withdraw consent at any time (Section 6).
21.3 Your right to object
You may object at any time, on grounds relating to your particular situation, to Processing based on our legitimate interests, and at any time to the use of your Personal Data for direct marketing. Write to privacy@tausquareacademy.com. We will stop that Processing unless we have compelling legitimate grounds that override your interests, rights and freedoms, or need the data to establish, exercise or defend legal claims. Because account security is part of how a paid program is provided, an objection to it may mean that we cannot continue to provide access to that program.
21.4 Automated evaluation
Device limits and the one-session-at-a-time rule are applied automatically, as described in our Terms of Use. Our security systems also evaluate account activity automatically to flag possible account sharing. They do not decide on their own: a person reviews the evidence before any account is suspended or permanently blocked, and you can explain your side before a permanent block.
21.5 International transfers
We are based in India, and our service providers (Section 7.1) may process your Personal Data in India, the United States and other countries that may not offer the same level of protection as your own. Where our service providers receive your Personal Data, we rely on their data-processing terms, including standard contractual clauses where these are required.
21.6 Your rights and complaints
You have the right to access, correct, erase and port your Personal Data, to restrict or object to its Processing, and to withdraw consent at any time without affecting earlier Processing. We respond within one month. You may also complain to the data protection authority of the EU or EEA country where you live or work, or, in the United Kingdom, to the Information Commissioner’s Office. We would appreciate the chance to address your concern first.
21.7 Whether you must provide your data
Providing your Personal Data is necessary to create an account and to enrol in a program. Without it, we cannot provide the Services to you. Updates about our programs are optional.
